Medical Marijuana Advertising Ban Introduced
Lawmakers in both the House and the Senate introduced legislation to ban billboard advertising for medical marijuana. Senator Rick Jones (R-24) and Representative Andy Schor (D-68) said in a press release that the legislation is in line with similar bans on tobacco billboard advertising. The bills, SB 463 and HB 4767, ban billboards for medical marijuana, dispensaries and businesses that provide access to the drug.
Though the bills do not mention radio and television advertising, the MAB has a long standing policy that any item legally sold should be legal to advertise.
According to MAB legal counsel David Oxenford, because medical marijuana or otherwise is not legal on the federal level, broadcasters are prohibited from advertising it anyway. Still the MAB does not want to see the confusion of dual restrictions in the event federal legalization were to pass.
